Article 1 - Definitions
In these conditions the following definitions are used:

Article 3 - Applicability
1 These general conditions apply to every offer of Scottybons and any agreement reached at a distance between Scottybons and consumer.
Article 4 - The offer
1 Scottybons creates a personal style advice on the basis of a style profile which has been filled in by the consumer, selects clothes for the consumer and sends this to the consumer. The customer then can choose which items she loves, and pays afterwards for the clothes that she has not returned to Scottybons (taking into account the provisions of these general terms and conditions).
2 Each offer includes besides the personal style advice an overview of the articles including their prices.
3 The price of the style advice is 15 euros, and this includes the cost of implementation in accordance with the contract, the delivery costs, the establishment of the payment, and the one-off costs of returning the items.
4 The mentioned prices in the offer of products or services include VAT.
Article 5 - The contract
1. The agreement is established at the moment the consumer accepts the offer and meets the corresponding conditions.
3 If the agreement is created electronically, Scottybons takes appropriate technical and organizational measures to protect the electronic transfer of data and Scottybons will ensure a secure web environment. If the consumer can pay electronically, Scottybons will do so to take appropriate security measures.
4 Scottybons can within the law inform the consumer's ability to meet its payment obligations, and of all those facts and factors that are important to a sound conclusion of the distance contract. If Scottybons under investigation was justified not to enter into the agreement, Scottybons is entitled to refuse an order or request or to attach special conditions to the request.
5 Scottybons will at least at the moment of delivery of the personal style advice and selected outfit send to the consumer the following information in writing or in such a way that it can be stored by the consumer in an accessible manner on a durable medium:
◦ the address of the establishment of Scottybons where consumers can lodge complaints;
◦ the conditions under which and the manner in which the right of withdrawal consumer can be exercised, or a clear statement regarding the exclusion of the right of withdrawal;
◦ information about guarantees and after sales service;
6 Price including all taxes of the product or service; where applicable, the delivery costs; and the method of payment, delivery or performance of the contract;
the requirements for terminating the agreement if the agreement has a duration of more than one year or is indefinite;
Article 6 - Right of withdrawal
1 The consumer may terminate an agreement regarding the purchase of items during the respite of 14 days without giving any reason. Scottybons may ask the consumer about the reason for withdrawal, but does not commit to stating his reason (s).
2 The respite referred to in paragraph 1 shall begin on the day the consumer, or a pre-designated by the consumer third party other than the carrier has received a clothing box , or, in contracts for regular delivery of clothes boxes for a certain period: for each regular box, the day on which the consumer or a third party designated by him, received the clothing box.
Extended respite for goods and services by not informing about right of withdrawal:
1 If Scottybons does not provide the consumer with statutory notice of the withdrawal right or the standard form for withdrawal, the withdrawal period shall expire twelve months after the end of the original respite determined in accordance with the preceding paragraphs of this article.
Article 7 - Obligations of the consumer during the respite
1 During the respite the consumer will treat the product and packaging with care. She will only unpack the product to assess size, color and fit. The premise here is that the consumer should only handle and inspect the product as he would be allowed to do in a physical shop.
2 The consumer is liable for diminished value of the product which is the result of carelessness retaining or fitting of clothing. The items must be in original condition, unworn and without stains or other damage.
3 The consumer is not liable for diminished value of the product as Scottybons did not provide the consumer to or at the conclusion of the agreement of all information required by law about the right of withdrawal.
Article 8 - Exercise of the right of withdrawal by the consumer and their costs
1 If the consumer exercises her right of withdrawal, she shall inform Scottybons within the respite by using the model form of withdrawal or any other unequivocal manner to Scottybons.
2 As soon as possible, but within three days from the day following the notification referred to in paragraph 1, the consumer shall send the items back, or she hands it to (a representative of) Scottybons. The consumer observed the returning period if she returns the products before the respite has been expired.
4 The risk and the burden of proof for the correct and timely exercise of the right of withdrawal lies with the consumer.
5 Scottybons will once bear the costs of returning if the return label which has been provided by Scottybons will be used.
6 If the consumer exercises his right of withdrawal, all additional agreements by law will be disbanded.
Article 9 - Exclusion right of withdrawal
1 Personal style advice is excluded from the right of withdrawal, when the consumer has accepted the agreement.
2 Sealed products that are unsuitable to be returned for reasons of protection of health or hygiene and which were unsealed after delivery;
Article 10 - Compliance and warranty extention
1 Scottybons guarantees that the products and / or services meet the contract specifications stated in the offer, the reasonable requirements of reliability and / or usability and on the date of the conclusion of the agreement existing legal provisions and / or government regulations.
2 The warranty on the products delivered by Scottybons is 6 months from date of delivery.
3 The consumer must lodge a complaint in respect of externally visible defects (or any call on the guarantee) within 14 days after delivery, if failing to do so any claim expires towards Scottybons.
4 Complaints (or any call on the guarantee) in respect of other shortcomings must, under penalty of loss of any claim against Scottybons, take place within 14 days when proved.
Article 11 - Delivery and execution
2 The place of delivery is the address that the consumer lets know to Scottybons.
3 Subject to what is stated in Article 4 of these terms and conditions, Scottybons will accept orders expeditiously but not later than 30 days, unless a different delivery period has been agreed. If delivery is delayed or if an order is not or only partially carried out, the consumer receives a massage no later than 30 days after placing the order. The consumer in this case has the right to terminate the agreement without penalty.
4 In case of dissolution in accordance with the preceding paragraph Scottybons pays back the amount that the consumer paid as soon as possible but no later than 30 days after termination.
5 The risk of damage and / or loss of products rests with Scottybons until the moment of delivery to the consumer or a pre-designated announced representative to Scottybons, unless explicitly agreed otherwise.
Article 12 - Duration agreement: termination and duration
1 The consumer may terminate at any time the agreement for an indefinite period, which extends to the regular delivery of goods and services taking into consideration the applicable termination rules and a period of notice of up to one month.
2 Consumers can the agreements referred to in the previous paragraph:
1 If a contract has a duration of more than one year, after a year, the consumer should the agreement at any time terminate with a notice period not exceeding one month, unless the reasonableness and fairness oppose termination before the end of the agreed term .
Article 13 - Payment
1 The amounts owed by the consumer should be paid within 5 days after the end of the respite. In case of an agreement to provide a service, this period starts on the day after the consumer has received the confirmation of the agreement.
2 When selling products to consumers, the consumer should in general terms never be obliged to advance payment of more than 50%. If payment is agreed, the consumer may not assert any rights regarding the implementation of the order or service (s) before the advance payment has been made.
4 If the consumer does not timely fulfill its payment obligation (s), this after she was pointed out by Scottybons on the late payment and Scottybons, the consumer has given a period of 9 days to fulfill his payment obligations, after failure to pay within this nine-day period, the outstanding amount of the legal interest and the operator is entitled to charge the extrajudicial collection costs incurred by her charged. These collection costs amounts up to: 15% of outstanding amounts to € 2,500; 10% on the next € 2,500 and 5% on the next € 5,000 with a minimum of € 40, -. Scottybons can – in benefit of the consumer - differ from these amounts and percentages.
Article 14 - Complaints
1 Scottybons has a well-publicized complaints procedure and deals with complaints under this procedure.
2 Complaints about the implementation of the agreement should take place promptly after the consumer has found the defects are defined clearly and completely submitted to Scottybox.
3 Complaints submitted to Scottybons will be provided within a period of 14 days from the date of receipt. If a complaint asks for a foreseeable longer processing time, then Scottybons will answer within the period of 14 days, confirming receipt and indicating when the consumer can expect a more detailed answer.
4 The consumer needs to give Scottybons at least four weeks time to resolve the complaint by mutual agreement. After this period a dispute arises which is subject to dispute , a dispute that is subject to dispute arrangement.
Article 15 - Disputes
Contracts between Scottybons and the consumer where these general terms refer to, only applies to Dutch law.
